Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you", "user") and Candidatoo, headquartered in São Paulo - SP, Brazil. By creating an account or using the service you agree to these Terms, to our Privacy Policy, to our Cookie Policy and, where applicable, to our DPA. If you do not agree, do not use the service.

1. The service

Candidatoo provides AI-assisted tools to organize career information, tailor resumes and cover letters, analyze job postings, and prepare for interviews. The service is offered "as is" and "as available" with the safeguards described in these Terms.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) and have legal capacity to enter into a contract. By using the service you represent that this is true.

3. Account, security and credentials

You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at info@candidatoo.com.br of any unauthorized access. We may suspend or terminate accounts that put the service, other users, or third parties at risk.

4. Acceptable use

You agree not to:

• Misrepresent your identity, qualifications or work history.
• Use the service to harass, defame, defraud, discriminate against, or harm others.
• Upload content you do not have the right to use, or that infringes intellectual property, privacy, image rights, trade secrets or applicable law.
• Attempt to reverse engineer, scrape, overload, or circumvent security or rate limits.
• Use the service to build a competing product, train AI models, or systematically resell our outputs.
• Use the service for purposes prohibited by law in Brazil, Canada, the United States or your country of residence.

5. Plans, credits, payments and refunds

The service is offered in free and paid plans, with monthly or annual billing handled by Stripe. AI actions consume credits according to the plan in force at the time of use. Prices, allowances and overage rules are listed on Pricing and may change with at least 15 days' notice. Brazilian consumers are entitled to the right of regret within 7 days for online contracts (CDC art. 49). For other jurisdictions, refunds follow the rules disclosed at checkout.

6. Intellectual property

• Your content. You retain ownership of resumes, profiles, prompts and any material you submit. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process and display that content solely to operate and improve the service for you.
• AI outputs. Subject to your compliance with these Terms, we assign to you, to the maximum extent permitted by law, the rights we may have over the outputs generated for you. You are responsible for verifying that outputs are accurate, lawful and non-infringing before use.
• Our IP. The Candidatoo brand, software, design, templates, scoring algorithms and documentation are protected and remain our exclusive property.

7. AI-specific terms

AI outputs are probabilistic and may contain errors or omissions. You must review every output before submitting it to an employer, an automated resume screening system, or any decision-maker. We are not responsible for hiring decisions or any outcome derived from your use of AI-generated content. We do not allow third-party AI providers to use your inputs or outputs to train their models.

8. No guarantee of employment

We do not guarantee job placement, interviews, salary outcomes or compatibility with any specific employer or automated resume screening system. Results depend on factors outside our control.

9. Third-party services

The service relies on processors including Supabase, Cloudflare, Stripe and AI providers (see DPA). The service may also link to third-party job sites or company pages; we are not responsible for their content or practices.

10. Suspension and termination

You may close your account at any time from your profile. We may suspend or terminate the service, in whole or in part, with reasonable prior notice, for security, legal, technical, regulatory or commercial reasons. Sections that by their nature should survive termination (intellectual property, liability, indemnity, governing law) will do so.

11. Warranty disclaimer

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Mandatory consumer rights under your local law (including Brazil's CDC) are not affected.

12. Limitation of liability

To the maximum extent permitted by applicable law, Candidatoo will not be liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost opportunities, lost data, or reputational harm. Our aggregate liability for any claim arising from or related to the service is limited to the greater of (a) the amount you paid to Candidatoo in the 12 months preceding the event giving rise to the claim or (b) BRL 500. None of these limits applies to liability that cannot be excluded under applicable law (fraud, willful misconduct, consumer protection, personal injury).

13. Indemnification

You agree to defend, indemnify and hold Candidatoo harmless from any claim, loss or expense (including reasonable attorneys' fees) arising from (i) your breach of these Terms, (ii) your misuse of the service, or (iii) your violation of any law or third-party right.

14. Privacy

Your data is processed under our Privacy Policy, which forms part of these Terms. We comply with the LGPD, the CCPA/CPRA and PIPEDA, as applicable.

15. Changes

We may update these Terms. Material changes will be announced by email and in-app notice with at least 15 days' advance notice. Continued use after that period means you accept the updated Terms; if you disagree, you may close your account before the changes take effect.

16. Force majeure

Neither party is liable for failures caused by events beyond reasonable control (acts of God, war, sanctions, large-scale internet outages, government action).

17. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, without prejudice to mandatory consumer protection rules of your country of residence (including the U.S. and Canada). The forum of the District of São Paulo - SP is elected, except where consumer law assigns the consumer's domicile.
